City pays out $275,000 to child hurt in physical education Class

A young child should never have to go through the struggles of a serious injury. It is a sad day for everyone when a child suffers a brain injury or other debilitating condition that makes it hard for them to talk, walk or otherwise interact like they used to.

Childhood injuries happen all the time, but they're not always under acceptable circumstances. Take, for example, this case involving a $275,000 settlement paid to the family of a child hurt in a school PE class.

The fourth grader was hit in the face with a soccer ball in 2016, suffering a concussion immediately and also suffering permanent blindness in one eye. The family decided to sue after accusing the elementary teacher of not providing adequate training to prevent this injury.

The interesting part of this case is that the award is part of a settlement. The school and teacher do not admit fault for the child's injury. Instead, they insist that there was no one truly at fault; it was a gym-class accident. Settling came down to a business decision, according to the city's attorney.

In this case, the proceeds of the settlement will go to a trust for the child. The child can access it at age 18, giving the child at least some funds as compensation for the loss of eyesight and head injury they had to go through.

Not all cases rely on fault to get a settlement. If your child is hurt, you should pursue all options to determine if there is a possibility of compensation for their injuries.
